This document outlines the terms and conditions relating to usage and purchases made from martinthomasbutchers.com website only

Definitions and Interpretation

In this document and website the following terms shall have the following meanings:

"Owner" "Member of management" - Means the owner of the physical business or e-commerce website and any member of management with authority to make decisions on behalf of the business in the eyes of the court or relevant authorities.

"Content " - means but not limited to text, graphics, images, audio, video, files, software, data compilations and any other form of information capable of being stored in or on a computer that appears on or forms part of this Web Site or in emails, downloadable files or printed literature produced by the business.

"Payment Information" - Payment method used to pay for products / services offered for sale on the website including but not limited to PAYPAL for online transactions from any PayPal accepted payment method, offline Credit cards (excluding American Express), Debit Cards or Bank transfer using bank account numbers and sort code or by E-cheque or existing funds in the account or any other means as agreed with the owners before using the site.

"Purchase Information" - means but not limited to any orders, invoices, dispatch notes, receipts or similar that may be in hard copy or electronic form relating to orders placed on or relating to the website.

"Business" "We" - Means Martin Thomas Butchers

"Web Site" - Means the website or sub domains contained within the site owned and operated by Martin Thomas Butchers

"Shopping basket" "Basket" - Means the location where items selected on the store are held virtually until the start of the payment process is initiated.

"Product image" "visual representation" - photographic or other pictorial or graphical image relating to or describing a product or collection of products on the site.

"User" / "Users" - the buyer or customer viewing or interacting with the website.

"User ID" - Means the unique ID selected by the customer when creating their account.

"Goods" "products" -means items advertised for sale on the website by Martin Thomas Butchers

"Trading location" "premises" "retail store" - Our retail shop and location where all the orders will be fulfilled from 10, Wolverhampton Road, Pattingham, South Staffs, WV6 7AF England

"Online" "Offline" - online refers to the website transactions completed by the user completely on the website including payment and delivery details / Offline refers to transactions where some or all of product ordering and the payment / address input is done via manual input with the user interacting with a member of staff at the business via telephone or email communications.

"Vouchers" "Gift certificate" - refers to a prepaid or money off code that will carry a value in Pounds (£) that can be used as a payment method on the site at the checkout page.

PRICING, WEIGHTS AND DESCRIPTIONS

PRICING AND WEIGHTS

All prices shown on the website are in Pounds (£) all weights for products listed as *ring for price* or *on request* will have their billing calculated on KILO (KG) weight. Where weights are displayed in POUNDS and or OUNCES (LB’s / OZ’s) these are for descriptive purposes only for customers to understand portions. The weight used for calculating pricing will always be KILO’s

Products listed on the site will be listed on a price per item code listing as such adding an item to the basket will increase the total by that multiplying factor.

The term to feed xx person(s) is based on the weight of raw boneless meat explained on the page in question. Bone in joints will have a different ratio again as a guide only.

The weight we will be weighing items over the scales will be in KILO or GRAMS as such the LBS (pounds) weight will be calculated by a computer converting the weight not weighing in LBS or OUNCES .

As all items are cut by hand and due to the nature of the product and animals not all being the same we are aiming for a tolerance of + / - 10% on all items that is not defined as for example 500g minced steak where it would be weighed accurately or pack of 6 4oz Steak burgers this does not imply that all items will be sold will be over or under the prescribed weight. For cooking weight of joints use the weight label applied at point of packing as this will be the actual weight. Items sold without a weight or where an approx weight only is listed are sold based on average of that item over a large amount e.g. 3 rack lamb contains 3 chops each chop being £x.xx would mean a price of 3x unit price.

 Products that are cut to customers own required size or weight and listed as “call for price” on the website will be priced when cut and added to your invoice accurately to be charged once the order is completed. This method will be by offline payment or by a payment invoice being created and sent to your email address given to us at time of ordering.

Due to the nature of the products offered for sale on the site the prices will be updated on a regular basis reflecting market prices, demand and seasons. This may mean some do not change for long periods and others change as often as weekly.


We res erve the right to withdraw, alter descriptions, product image, pack sizes or remove any goods from the Website at any time without notice.
We shall not be liable to anyone for withdrawing any Goods and or Services or for refusing to process an order.
Orders are accepted at our sole discretion and we maintain the right to decline orders without giving an explanation.

We reserve the right to withdraw or suspend any special offer product, pack, or promotional items, offers or discount code at any time without giving an explanation.

Should we believe that discount codes are being used or have been obtained illegally we reserve the right to cancel all codes / vouchers of that type. Should this mean genuine customers codes be affected customer services will resend NEW codes to the original purchaser of the codes through the email given on completion of USER ID

WEBPRICING

The prices on the site relate to website only as some items advertised on the site are not available in the retail store. Specials available in the retail store may not be available on the website and WEB ONLY promotions are only available to purchasers buying via the site not in the retail store.

PHOTOGRAPHS / IMAGES USED

All images on the site are for illustration purposes only, where a single image has been used to demonstrate a cut and is over several images the wording along with the image relates to the amount of product or actual cut to be sold.

PAYMENT

Payment for items offered for sale on the website may be by any of the following methods.

Online PAYPAL (Credit / Debit cards or any other method PayPal have authorised on your account including existing funds and Echeque) Please be aware that E-CHEQUE’s on PayPal will delay the processing of your order. Until payment is cleared and confirmation received your order will not be processed.

Offlineis available where you can ring or email our customer service team with an order using the codes on the website and once your order is manually created a member of staff will telephone you for payment instructions and then indicate to you a selection of dates your order would be ready for you to take delivery of it. This is also the way to place an order if you wish to place an order and then collect the items from the shop if you live within driving distance, where your order will then be processed in the same manner.

Vouchers / Gift Certificates / Pack vouchers the use of the codes that make up the value aspect of Gift Certificates or Pre paid vouchers can be used as part or full payment on the site only, not by manual processing this is for security reasons. Each code can only be used ONCE by each individual USER ID and in full but can be used as full or part payment of the order placed by the customer depending on the value of the voucher or certificate they have in their possession. If used in part payment then the remaining balance must be paid by PayPal on the site.

Pack Vouchers may be redeemed by the following methods, mailing in the card in full with all detail completed as required, by email by requesting a redemption form from customer services or by entering your code into the website, some but not all pack vouchers may include delivery in the price but it is the redeemers responsibility to notify the customer services team of payment details if they are not included in the pack they are redeeming.

Vouchers may be purchased from the site by the person intending to redeem them or by way of gift to another person either sending the code via electronic means or by mailing the printed voucher code. These codes have a validity of 240days from date of issue and have no cash in value and are only valid on the website not as payment in the retail shop where the business trades from.

Should the pack the voucher is issued in exchange for change for any reason or be withdrawn the purchaser will be notified of the change this may mean that the new pack may contain less or different items to the previous but will still be the same value of products as the previous pack.

Should a customer change email address or home address from when the voucher was issued contact customer services for the details to be amended on the computer prior to use.

Purchase of prepaid Vouchers or Gift Certificates, these may be purchased on the site and at the shop directly, those purchased at the retail store will receive their voucher code at their email address indicated on the request form in not more than 48 hours. Those ordering via the website will receive this within 24 hours from purchase.

Stock Levels

We aim to maintain stock levels of over 97% of all items listed on the website in the quantities available for purchase in the purchase box by each customer alongside each product on their respective pages. Should maximum numbers not be shown this is due to larger amounts of these items being available as such limits over 15 units will be available to a user in a single transaction. Vouchers for future redemption – multiple item packs – promotional products – one off special order items will have number limits set by the management.

Single items

We aim to maintain listings of sufficient products for all users to purchase their requested amounts by reviewing and monitoring trends of users on a weekly basis and alter product quantities in certain products to compensate for expected demand.

Special order

Special order items including Christmas poultry and meat cut to size are only available to order in quantities as determined by the listing as quantities of a certain cut or weight may be limited and extra stocks may not be added until more stocks are guaranteed off the farm in the case of Christmas Poultry or when the next carcase is to be cut which may be up to three days depending on the hang time of the meat in question.

Multi buy packs

Named or numbered product packs containing more than one type of product as described in the listing will only be available to purchase in a maximum of three units of exactly the same pack in any single transactions this is due to the lower numbers of products listed on the site and to ensure even distribution of stock levels and products contained within.

Extra Matured

Meat that has been matured for a longer period than the standard stock line 14 days for beef and 7 days for lamb shall have a smaller quantity of the product listed on the site reflecting the specialist nature of the product for sale. These when delivered will be labelled with an additional label to identify the age of the item in question.

Vouchers

Vouchers and gift certificates are available to purchase at a maximum of two per person of each type in any single transaction.

Back orders / Part orders

We aim to ship all orders placed in a single shipment but should an item other than items not due in until a specified date example Christmas Poultry not be available we reserve the right to ship once available but our customer services team will notify by email of this so should you wish to remove this from your order you can and receive a refund of that item on your initial invoice.

Value Added Tax (VAT)

This will be included in all the amounts on the website should it be chargeable, currently meat / meat products are non vat rated. If any items you purchase do include VAT the invoice you receive with your order will contain the breakdown showing the total excluding and including at the prevailing rate at the date of ordering not date of delivery.

DELIVERY

All deliveries will be by courier unless your address is in an area where we deliver with our own vehicles on the day you requested your order then our own staff would deliver this under the same terms and conditions a signature will be required by the person accepting the order.

 All products will be delivered in packaging designed to ensure the safe delivery and temperature holding of the products contained inside.

Delivery charges are set out in the delivery page of the website normal delivery days are Tuesday through Friday as the orders are collected from us the day before and delivered on a next day basis as such Monday is not available.

There is a surcharge for Saturday delivery and we reserve the right to split your order over multiple boxes to best accommodate the products or to even the weight out to ensure the box does not break if handled incorrectly.

Any orders placed where a customer indicates they wish to collect the order from the RETAIL STORE will upon collection of order receive at their choice a VOUCHER to the value of the postage paid on the site at checkout which can be used against a purchase from the website for a future purchase subject to terms and conditions of voucher use. OR a refund via the payment method made on the site either within 48 hours from collection.

CANCELATION PROCESS

You may cancel or abort your order at any time on the website until agreeing to the terms and conditions before being transferred to the payment gateway when your basket is complete.

After this stage you will receive an email confirming your order and a further email off our customer service team indicating delivery dates available to you. At this stage your order is legally binding and will be processed in line with our terms and conditions that you have agreed to and except in exceptional circumstances our customer services team are not required to cancel your order or issue a refund as some or all of the items may have been selected and or cut specifically to your order size or specific order.

GUARENTEE

We guarantee that all meat supplied meets our high standards and is of the age, cut and weight as described and packed to the highest standards using the strongest packaging available to ensure the product is in the best condition when you the customer receive your order.

We have tested the packaging on numerous occasions and the chill medium used is capable of holding temperature for 36 hours longer than required during transit period so even if we do have hot weather the insulation in the box and medium used are capable of holding a lower temperature for a longer period than we will require of them during shipping of your orders.

If there is a problem with your order, please contact us. We will deal with the matter in accordance with your legal rights

Any items that we do request to be shipped back we will notify the courier company to arrange collection once you notify us it is ready to be collected, return by any other method after we have instructed our courier to collect will result in the consumer paying the carriage on the items and any subsequent charges levied by our courier company.

 (DISTANCE SELLING REGULATIONS)

As all the products we offer for sale are FRESH / CHILLED and PERISHABLE products, in line with Consumer Protection (Distance Selling) Regulations 2000 Regulation 13 3.38 --- they are not sold on a TRIAL basis with a cooling off or right to return period.

 FORCE MAJEURE

Should through natural disaster, War, civil unrest including but not limited to Earthquake, flooding, fire, storms , lightning, Rioting, rationing, national strike we reserve the right to cancel all new orders placed and delay any shipment of existing orders until the business is back in operation.

WEBSITE AND CONTENTS

We are not liable for any third party links if any on the website to sites not owned and or maintained by Martin Thomas Butchers directly.

Any links on the website will be to companies we have worked with in the past who we believe are trustworthy and may be of interest to our customers but we do not endorse any of the companies or the products they offer for sale.

We reserve the right to restrict access to the website from countries to which we do not deliver to should we wish at a later date.

No part or content contained in the website shall be copied, distributed or sold for financial gain.

Only the homepage may be linked by bookmark to a users personal browser for easy future reference.

All images and text contained on the pages contained on the site are copyright of Martin Thomas Butchers or licensed for usage on the site by Martin Thomas Butchers from license holder usage without expressed written permission of the site owner or owner of the image is deemed as breach of copyright which may be liable to legal action being taken.

Any linking of the site to but not limited to comparison, marketing, promotional or similar type of site anywhere in the world unless with written permission of the owner prior to linking will result in legal action being taken.

CHANGES TO TERMS AND CONDITIONS

Should any changes take place to the terms and conditions the buyer will upon using the site agree to these changes and the business need not notify or highlight any changes made to the existing terms and conditions but should it affect orders already placed and in process the customer(s) involved, would be notified and asked if they agree to the new terms and conditions if they do not a full refund on any order would be processed in accordance with the businesses usual procedure.

WAIVER

No waiver by the Supplier (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

REFUNDS

We aim to process full or partial refunds on the PayPal payment system within 4 working days. Credit / Debit cards within 7 working days if processed manually. Other payment methods including but not limited to bank transfer, Cheque, postal / money order (where authorised prior to order being placed) will receive their refund via cheque to the name on the original order and to the delivery address within 10 working days.

Vouchers

Should payment be made in full or part by pre purchased voucher either directly purchased by the user or received as a gift from another person this will be taken as the initial payment method and as such will be reissued in full with and remaining part or full refund taken out of the secondary payment method, (PayPal, Credit / Debit cards) in the same time period as described for single refund methods. At no stage will vouchers be exchanged for CASH directly and their expiry will be not less than 180days (6 months) from date of issue or reissue.

AGE OF CONSENT

Should Goods and or Services offered may only be purchased by persons of a certain legal age example not to under 18 years the Buyer will be asked when placing an order to declare that they are of the appropriate legal age to purchase the Goods and or Services advertised on the website. Should they not check the relevant box those products will be removed from their order and not processed. Any time an age limit is enforceable we will store all IP’s of those users if require for compliance of any legal organisation enforcing compliance.

Should the owner or member of staff discover that the Buyer is not legally entitled to order Goods and or Services advertised for sale on the website, for reasons including but not limited to under age of consent, paying with a fraudulent payment procedure or method, not at an address that is verified by the selected payment company used in transaction, is not in a region the business ships to, the Supplier shall be entitled to cancel the order immediately, without notice. Notifying the relevant payment company to reverse the payment should it already have taken place, or take any action they believe needs to be taken not limited to informing credit reference agencies or investigating authorities, should fraudulent transactions take place.

GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
